What Is Covered
By This Agreement
This coverage supplements the new vehicle warranty provided by the
manufacturer of the covered vehicle. We will remedy any Mechanical
Failure to your vehicle, less your deductible except for
items listed under the section "What is not Covered by Vehicle
Service Agreement."
What Is Not Covered By This Vehicle Service Agreement (Exclusions)
This Vehicle Service Agreement will not cover repairs for the
following:
| 1. |
Incidental or Consequential Damage
or Loss caused by a breakdown of covered components including
property damage, personal injury, inconvenience, loss of vehicle
use, commercial loss and punitive damage or exemplary damage
or attorney fees. |
| 2. |
Repairs covered under a repairers
guarantee or the original manu-facturers warranty whether
or not the underlying warranty was transferred with the vehicle
are not covered. |
| 3. |
Pre-existing conditions that have
manifested through the gradual reduction in operating performance
and whose condition predates the activation of the service agreement. |
| 4. |
For repairs when the covered vehicles
mileage has been altered or whose mileage has been tampered
with. |
| 5. |
For repairs made outside the United
States of America or Canada. |
| 6. |
Vehicles used for business or
commercial purposes, or registered as a commercial vehicle. |
| 7. |
Failures resulting from sludge
deposits, contamination or operation without the proper lubrication
levels or fluid type and/or failure to perform the manufacturers
recommended maintenance. |
| 8. |
Damage caused by continued operation
of a mechanically impaired vehicle, towing or overloading beyond
the vehicles capacity. |
| 9. |
Vehicles that have been branded
or retitled as salvage or total loss. |
| 10. |
Repairs beyond those required
to correct a covered Mechanical Failure. |
| 11. |
Repairs required because of freezing,
rust or corrosion, collision, abuse, snow plowing, neglect,
negligence, misuse, alteration, modification, road hazard, racing,
vandalism, riot, upset, theft, fire, flood, fraud, misrepresentation,
acts of God or any loss that is covered by Casualty Insurance. |

Service adjustments, reprogramming
and cleaning, alignment, refrigerant, coolant, lubricants, filters,
fluids, batteries, belts, (except timing belt and serpentine
belt not subject to maintenance replacement), hoses, filters,
PCV, ignition coil, ignition wires, spark/glow plugs, EGR valve,
and oxygen sensors, tune up, wiper blades, tires, wheels, wheel
balancing or alignment, MacPherson struts, shock absorbers,
disc brake pads and rotors, brake shoes and drums, manual clutch
disc/pressure plate and throw out bearing, fuses, light bulbs,
sealed beams and lenses, exhaust systems includ-ing catalytic
converter, air conditioning recharge, shop supplies, freight
and hazardous waste removal charges. Repairs to retrofit, reprogram
(except in conjunction with a covered repair), or replace components
due to compliance with any law or legislation. Repairs to seized
or damaged engines due to continued operation lubricants or
coolants.
NOTE: It is your responsibility to make certain that the oil
and temperature warning lights/gauges are functioning properly.
You must take precautions against causing any further damage
to your vehicle when either the lights/gauges indicate inadequate
pro-tection or performance. Repairs to retrofit or replace components
due to compliance with any law or legislation including the
1990 Clean Air Act. Glass body structure and frame, bright metal,
bumpers, sheet metal, moldings, weatherstrips, ornamentation,
paint, rust, corrosion, side view mirrors, squeaks, wind, air,
and water leaks, wheel covers, vinyl tops, convertible tops,
buttons, knobs and handles, upholstery, trim, carpeting, dash
pad and console, interior rear view mirror, vanity mirror, cellular
phones, CB radios, radar detectors, non manufacturer installed
equipment including anti-theft system, radios, cassette/CD players,
graphic equalizers, amplifiers and speakers, TV, CD and video
cassette players and monitors. |
| 13. |
Tire damage caused by (a.) abnormal
wear caused by misalign-ment; (b.) any tire with less than 3/32
inch tread depth; (c.) rim leaks, porosity leaks, or misuse
caused by underinflation; (d.) loss to space saver, factory
second type, retread or recapped tires (e.) reimbursement for
towing, wheel alignment, wheel straightening, wheel balancing,
suspension repair, or replacement for components that are not
listed as covered under this Agreement. |

For any claim not authorized in
advance by Us. |
| 15. |
Modifications to the vehicle. |
| 16. |
Warranty of Merchantability or
Warranty of Fitness for a particular pur-pose is expressly excluded. |
| 17. |
Fraud |
| 18. |
Excessive oil comsumption, loss
of compression and gradual reduction in operating performance
in covered components due to normal wear and use. |
| 19. |
Gray Market vehicles
imported without U.S. Government certification and without their
original manufacturers-United States underlying warranties. |
Additional Benefits
Towing and Road Services
Road America Motor Club
The following are covered:
| 1. |
Towing Assistance When
towing is necessary, the covered vehicle will be towed to a
service facility. |
| 2. |
Battery Service If a battery
failure occurs, a jump-start will be applied to start the covered
vehicle. |
| 3. |
Flat Tire Assistance Service
consists of removal of the flat tire and its replacement with
the spare tire. |
| 4. |
Fuel, Oil, Fluid and Water Delivery
Service An emergency supply of fuel, oil, fluid and water
will be delivered if you are in immediate need. You must pay
for the fuel or other fluid when it is delivered. |
| 5. |
Lock Assistance If your
keys are locked inside of the vehicle, we will provide assistance
in gaining entrance to the vehicle. |
| 6. |

Taxes and Fluids
Also covered are state and local taxes
where applicable and fluids to complete a covered repair.
Road Hazard/Tire Coverage
Original vehicle manufacturer
installed tires properly mounted on the covered vehicle. Reimbursement
is based on the price of the original tire as delivered on the covered
vehicle. Covered damage is defined as any damage caused by road hazard.
Rental
In the event of a covered mechanical failure, the Administrator
will reimburse you for actual expenses incurred for substitute transportation
at the maximum daily rate of $35.00 per day, not to exceed 6 days.
One days rental shall be allowed for each four (4) hours, or
portion thereof, of actual repair labor time as listed in a nationally
recognized labor time standard. If a physical inspection of your vehicle
is required prior to claim authorization, we will allow one additional
day of rental reimbursement. A substitute vehicle must be rented from
a licensed rental agency.
Travel Expense
In the event of a covered Mechanical Failure, the Administrator
will reimburse you for up to $100.00 per day for a period
not to exceed five (5) days for restaurant, meals and lodging that
you incur for staying at a hotel/motel when your vehicle
can not be operated and is more than 100 miles from your home.
Meals and lodging are required because the Mechanical Failure
causes a delay en route and the day of the Mechanical Failure
is considered the first day of the five (5) day period. The expense
that you incur must be between the time of Mechanical Failure
and the time when the repairs are completed or by the end of the fifth
day. Receipts are required as evidence of expenses incurred.
